Texas Asbestos Laws
There are a number of rules and regulations related to asbestos in Texas, in addition to laws enforced at the federal level. As with many other states, Texas regulates the use, sale, transportation, and creation of asbestos products. The primary concerns of asbestos legislation in Texas is the presence of asbestos in the workplace and emissions standards.
Texas Asbestos Health Protection Act
Passed in June 2003, the Texas Asbestos Health Protection Act sets standards around monitoring air quality in occupational settings. Incorporated into the state’s Occupations Code, the law requires the executive commissioner of the Texas Health and Human Services Commission to set standards around the maximum level of airborne asbestos allowed in the workplace, as well as various performance standards and work practices. It also deals with asbestos licensing requirements, inspections, and investigations.
A large section of the law is around licensing and registration. In Texas, licensing is required for a variety of individuals who handle (or oversee the handling of) asbestos. This includes:
- Asbestos abatement contractors and supervisors
- Asbestos inspectors
- Asbestos management planners, consultants, and training sponsors
- Transporters of asbestos-containing materials
Licensing requires passing an examination and paying any related licensing fees. Anyone engaged in certain activities related to asbestos – such as removal, maintenance, repair, or installation of materials that contain asbestos – must also be registered with the state.
Another part of the law provides regulations around demolitions and renovations of workplaces. These rules are in line with the U.S. Environmental Protection Agency’s (EPA) National Emission Standards for Hazardous Air Pollutants (NESHAP). However, in certain circumstances, renovation and demolition projects can be exempted from following the NESHAP standards, in which case the Texas Asbestos Health Protection Act allows the executive commissioner to likewise exempt the project at the state level.
In December 2016, the Executive Commissioner of the Health and Human Services Commission published a set of proposed rule changes on the Texas Register. These changes incorporate previous rule clarifications, updates to licensing requirements, and explicitly adopts NESHAP standards by reference.
Texas Asbestos Safety Guidelines
As noted above, most states follow the EPA's NESHAP air quality standards, which includes asbestos-related provisions, and Texas is no exception. The primary authority with respect to asbestos safety issues is the Texas Department of Health and Human Services, which works with the Texas Commission on Environmental Quality with respect to the inspection of solid waste facilities that accept asbestos waste.
For anyone who does not properly follow the appropriate asbestos safety guidelines in Texas, enforcement actions may be taken against them. These actions can be taken for a variety of reasons, such as failure to provide notification about demolitions, failure to monitor projects that involve asbestos, failure to properly monitor asbestos abatement activities, and failure to conduct a thorough asbestos inspection. Each of these actions carries a monetary penalty, and they may come with other conditions related to the penalty.
