Understanding the Flintkote Asbestos Trust Fund

On May 1, 2004, Flintkote Company filed for Chapter 11 bankruptcy for reorganization through the United States Bankruptcy Court for the District of Delaware in response to several asbestos lawsuits filed against the company. Flintkote’s wholly owned subsidiary, Flintkote Mines Limited, filed for a voluntary petition for reorganization under Chapter 11 of the United States Bankruptcy Code on August 25, 2005. They created an asbestos trust fund to cover all asbestos personal injury claims for which either company have legal responsibility.

The Flintkote Asbestos Trust fund was officially established on September 30, 2015 and began accepting asbestos claims. The Delaware Claims Processing Facility, LLC continues to handle these Flintkote asbestos claims today.

Flintkote Asbestos Trust Payment Percentage

The Flintkote Asbestos Trust will compensate asbestos victims based on the payment percentage system that is designed to preserve money for future claims. The current Flintkote asbestos trust payment percentage is 15%. At a payment percentage of 15%, a Flintkote mesothelioma claim filed under the expedited review process can be expected to receive the minimum standard scheduled value payment of $27,600.

The Flintkote Company was founded in 1901 and became incorporated in 1917. It is best known for manufacturing roofing products. The company expanded to manufacture cement, joint compound, floor tiles, pipe insulation, siding, and other building materials.

Although the safety hazard associated with asbestos exposure became known, Flintkote continued to manufacture products using the toxic material and put workers and consumers at risk of developing mesothelioma.

Key events in Flintkote’s asbestos history include:

  • 1930s: The Flintkote Company experienced financial success while manufacturing asbestos-containing products.
  • 1945: The Flintkote Company created Flintkote Mines Limited as its subsidiary to operate an asbestos mine in Quebec, Canada. The Canadian subsidiary supplied some of the raw asbestos until 1971.
  • 1970s: Flintkote began facing an increasing number of asbestos lawsuits for the company’s role in asbestos injuries.
  • 1982: Flintkote discontinued using asbestos in its products.
  • 1987: The company sold its construction, stone, and cement products unit to address asbestos litigation costs.
  • 2001: A Pennsylvania jury awarded over $1.5 million to two plaintiffs in a consolidated case whose husbands died of mesothelioma after exposure to asbestos from working with Flintkote products in shipyards.
  • 2004: After facing over 350,000 Flintkote asbestos lawsuits that cost hundreds of millions in legal fees, along with approximately 157,000 pending asbestos claims, the company filed for Chapter 11 bankruptcy. This was followed by Flintkote Mines Limited filing for bankruptcy a few months later.
  • 2015: Travelers Casualty & Surety Company agreed to pay Flintkote $1.7 million to resolve a dispute over remaining product-liability obligations linked to thousands of asbestos and mesothelioma claims, under their 1985 Wellington Agreement. This was an industry-wide agreement designed to standardize the system to resolve asbestos personal injury claims and reduce legal conflicts between insurers and insured companies.
  • 2015: The Flintkote Asbestos Trust was officially established to handle all current and future asbestos claims filed against the Flintkote Company and Flintkote Mines Limited.

  • Asbestos cement: A fire-resistant building material used for roofing, siding, and industrial panels.
  • Asbestos cement board: Flat sheet material used in construction of walls, ceilings, and for insulation and fireproofing around boilers and other heat-generating equipment.
  • Asbestos cement siding: Used on exterior wall coverings of homes and commercial buildings.
  • Asbestos cement roofing: Commonly installed in overlapping panels on industrial, agricultural, and utility buildings.
  • Vinyl asbestos floor tiles: Widely used in residential and commercial buildings for flexibility and durability. Cutting and removing these tiles releases asbestos fibers.
  • Joint compound: Used to cover drywall seams, seal joints, and create a smooth finish.
  • Pipe insulation: Wrapped around piping and heat systems to improve heat retention.
  • Roof coating: Protective coating applied over roofs.
  • Roofing felt: Asphalt-coated paper containing asbestos that was applied beneath shingles, tiles, or other roofing materials.
