Massachusetts Jury Awards $8 Million Mesothelioma Verdict

A Massachusetts jury recently awarded $8 million to an 84-year-old woman who was diagnosed with mesothelioma.

Brian Kenney of Early, Lucarelli, Sweeney and Meisenkothen worked alongside the Dean Omar Branham Shirley trial team consisting of Ben Braly, Anthony Bianco and Aaron Chapman, as well as Amy Carter with the Carter Law Group. Together, they secured a verdict against Johnson & Johnson in Boston for $8 million. Johnson & Johnson offered $0.00.

The client was diagnosed with mesothelioma in June 2021. She is a remarkable woman who raised seven children. Throughout her life, she used Johnson’s Baby Powder as part of a daily routine. She also used the talcum powder on her children. The family of nine shared a small home with a single bathroom for over 20 years.

Johnson & Johnson was found liable under a design defect claim by a jury and the corresponding negligence claims, which were based in design as well.

This was the first case to get tried in Boston since the asbestos administrative judge issued a new pretrial order, which requires trials to conclude within two weeks, and three days advanced notice of all slides intended to be used with witnesses. It was an indication of how these cases may now proceed in Boston with these new rules in place.
