Filing Mesothelioma Lawsuits in New York

In most cases, mesothelioma victims or their survivors can file an asbestos-related action in any state where they have provided military service, been employed, or lived. Even if you are not currently stationed, working, or residing in New York, you may be able to file an asbestos claim if the relevant exposure occurred in that state.

Our skilled attorneys can help you determine the appropriate venue for your case. We can also offer guidance on which court would be most likely to hear your case favorably, based on your circumstances.

New York Asbestos Laws

New York has passed numerous laws that regulate the manufacture, use, and distribution of asbestos products. Many of these laws focus on improving air quality, asbestos abatement, and litigation in state courts.

Asbestos Litigation in New York

When it comes to asbestos litigation, New York is one of the most active areas in the country. In particular, New York City sees so many asbestos-related lawsuits that a special court has been established to try asbestos cases: New York City Asbestos Litigation (NYCAL) court. There is a dedicated NYCAL website that gives law firms access to important documents, forms, rulings, and other materials related to asbestos litigation. Similar NYCAL cases are frequently combined to help streamline the litigation process, and cases brought by terminally ill plaintiffs who have short life expectancies are given preferential access to the court process.

New York is readily acknowledged as issuing the greatest amount of compensation to asbestos exposure victims of any state in the U.S. According to one report, from 2010 – 2014, plaintiffs received an average of $16 million per claim, which is more than twice the national average. In recent years, there is increased potential for that number to go up, as in April 2014 Justice Sherry Heitler removed certain restrictions on punitive damages for asbestos cases in New York.

Asbestos Safety Guidelines in New York

In New York, asbestos safety guidelines are primarily carried out by three state agencies – the Department of Health, Department of Labor, and Department of Environmental Conservation. As with other states, New York also adheres to the National Emissions Standards for Hazardous Air Pollutants (NESHAP) guidelines published by the U.S. Environmental Protection Agency (EPA).

The primary asbestos regulations protecting workers in New York are found in Title 12, Part 56 of the Official Compilation of Codes, Rules and Regulations of the State of New York (NYCRR), and they fall under the jurisdiction of the Department of Labor. These rules and regulations contain all of the various requirements employers must follow with respect to asbestos, including licensing and certification, air sampling, work area preparation, as well as abatement, cleaning, and removal of asbestos from work sites. In addition, the Department of Health administers an Asbestos Safety Program to protect employees by offering asbestos safety training.

The New York State Department of Environmental Conservation (NYSDEC) oversees the implementation of the EPA’s NESHAP standards, as well as providing regulations for the transport and disposal of asbestos and asbestos containing materials after abatement or removal projects. In particular, transporters must receive permits to transport asbestos waste to a landfill. Solid waste management facilities also must adhere to certain NYSDEC guidelines when handling asbestos waste.
